Privacy policy – Losawo

Welcome to the privacy policy of Losawo (“Losawo”, “we”, “us” and “our). Please read this privacy policy carefully to understand our privacy policy and practices regarding your personal data/personal information and how we will treat it. In the Personal Data Protection Act AD 2019 ("PDPA"), which includes names, e-mail addresses, postal addresses, birthdates, telephone numbers, identity card numbers and other details that may identify customers, the word "personal information" is specified. This privacy policy extends to individuals who, as customers ("you"), connect with Losawo services and order products. We take data protection very seriously and abide by the EU General Data Protection Regulation (GDPR) and other relevant privacy laws that govern our jurisdiction. The data controller within the meaning of Article 4 (7) of the EU General Data Protection Regulation (GDPR) which is responsible for the processing of your personal data is Losawo. Your usage of our services is consent to be bound by this privacy policy.

USE OF PERSONAL INFORMATION
Losawo will use the personal information of Customers only for the purposes specified to Customers at the time of collection of such information and for the purposes set out in this Policy and will not use the information for any other reason unless Customers have provided their consent or if it is allowed or necessary by law. Losawo may use Personal Information for the following purposes:
To fulfill obligations for the Customers;
Develop and improve our products and services for the Customers;
to comply with the law;
to provide Customers with information on Losawo's products and services;
to update Customers record;
for any other purpose.

COLLECTION OF PERSONAL INFORMATION
Personal information you provide to us.  Personal information you may provide to us through the Service or otherwise includes:
● Registration data, such as information that you provide to register for an account or sign up for an event, including the day and month of your birth and the event you registered for.
● Contact data, personal or business contact information such as your first and last name, email and mailing addresses, phone number and professional title.
● Profile information, such as your username and password that you can set up with us and your interests and preferences to create an online account.
● Communications, such as data you provide when you contact us with questions, input, survey answers, or otherwise contact us,
● Marketing data, data for any marketing communication
● Purchase data, including billing address or order history
● Other information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.

Data from other sources. 

We can also gather data about you from:
Corporate partners such as advertising partners and joint marketing partners.
Data providers, such as data services and licensors of information.
Public platforms, such as blogs , forums or sites on social media.

Automatic Collection. 
We and our service providers may automatically log information about you, your computer or mobile device, and your activity occurring on or through the Sites, such as:
● Device data, such as your computer or mobile device operating system type and version number, manufacturer and model, browser type, screen resolution, IP address, the website you visited before browsing our site, and general location information such as city, state or geographic area.
● Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.

International Transfers

Customers' personal information may be transferred to a place outside Thailand. Customers' personal information is collected from various sources, including information provided by Customers or someone acting on Customers' behalf, information from third parties or information in the public domain.

Customers are required to provide the personal information as required to be processed by or on behalf of Losawo as described above. If customers

PROTECTING PERSONAL INFORMATION

Losawo has implemented the following measures to properly manage and protect Customers' personal information:

Establishment of an organization to promote and ensure protection of all personal information held by Losawo as a whole, and appointment of personal information controllers;

Establishment of internal company rules based on Personal Information Protection Laws and guidelines issued by the relevant authority concerning the handling of personal information;

Education of employees and others concerned to ensure that they understand the importance of personal information protection and are thoroughly familiar with all relevant rules and guidelines;

Establishment of a personal information management register and enforcement of appropriate restrictions on access to personal information; and

Implementation of appropriate and reasonable security measures to prevent unauthorized access to, or leakage, destruction or alteration of, personal information.

DISCLOSURE

Losawo shall not provide or reveal to third parties the personal details of its customers, except in the following cases:
The customer whose personal information is to be released has received prior consent; Disclosure is necessary or approved by law or by a court's order;
In connection with company succession, personal information is given due to merger, spin-off or otherwise.

CONTROL

Occasionally, Losawo consigns to outside service providers the processing of personal details. Only service providers that have been reported to have the ability to manage personal information appropriately will be chosen. Furthermore, Losawo offers and discloses to such service providers the personal information of Customers strictly in accordance with the Scope of Use and allows them, by written contract or similar means, to manage personal information appropriately and to regularly check compliance with it.

RESPONSE CONCERNING PERSONAL INFORMATION

When a customer demands clarification, revision (correction, addition or deletion), termination of use or deletion of his / her personal details, Losawo will comply with the request upon verification of the identity of that customer, unless there is a fair justification for refusing to do so.

Customers can withdraw their consent to us collecting their personal information at any time. In the event that the withdrawal is complied with, Losawo will not be able to meet all of its contractual obligations owing to the Customer and, moreover, Losawo will not be able, if at all, to effectively make its services to the Customer. We will make every effort to comply with any feedback or concerns about our use of personal information from customers in a timely and effective way.

CONSENT

By providing their personal information to us, Customers thereby consent to the processing of their personal information in accordance with this Policy. Customers further thereby confirm that they have obtained the consent from the person(s) whose personal information may be given to us by Customers or identified from the Customers' personal information which may be processed by us for the purposes stated herein including disclosure to the parties stated herein in this Policy.

DATA PROTECTION RIGHTS UNDER THE GDPR

Losawo is committed to ensuring fair and transparent processing. That is why it is important to us that data subjects can not only exercise their right to object but also the following rights where the respective legal requirements are satisfied:

● Right to deletion (“Right to be forgotten”), Art. 17 of the GDPR
● Right to limit processing, Art. 18 of the GDPR

CCPA

We are required by the California Consumer Privacy Act of 2018 (“CCPA”) to provide to California residents an explanation of how we collect, use and share their Personal Information, and of the rights and choices, we offer to California residents concerning that Personal Information. 

Personal information that we collect, use, and share.  We do not sell personal information.  As we explain in this Privacy Policy, we use cookies and other tracking tools to analyze website traffic and facilitate advertising. 

Your California privacy rights.  The CCPA grants California residents the following rights.  However, these rights are not absolute, and in certain cases we may decline your request as permitted by law.

● Information. You can request information about how we have collected, used and shared and used your Personal Information during the past 12 months.
● The categories of Personal Information that we have collected.
● The categories of sources from which we collected Personal Information.
● The business or commercial purpose for collecting and/or selling Personal Information.
● The categories of third parties with whom we share Personal Information.
● Whether we have disclosed your Personal Information for a business purpose, and if so, the categories of Personal Information received by each category of third party recipient.
● Whether we’ve sold your Personal Information, and if so, the categories of Personal Information received by each category of third party recipient.
● Access. You can request a copy of the Personal Information that we have collected about you during the past 12 months.
● Deletion. You can ask us to delete the Personal Information that we have collected from you.
You are entitled to exercise the rights described above free from discrimination in the form of legally prohibited increases in the price or decreases in the quality of our Service.

How to exercise your California rights. 
You may exercise your California privacy rights described above as follows:


● Right to information, access and deletion. You can request to exercise your information, access and deletion rights, by emailing ____@losawo.com. We reserve the right to confirm your California residence to process your requests and will need to confirm your identity to process your requests to exercise your information, access or deletion rights.  As part of this process, government identification may be required.  Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government issued identification.  We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.

● Request a list of third party marketers. California’s “Shine the Light” law (California Civil Code § 1798.83) allows California residents to ask companies with whom they have formed a business relationship primarily for personal, family or household purposes to provide certain information about the companies’ sharing of certain personal information with third parties for their direct marketing purposes during the preceding year (if any).  You can submit such a request by sending an email to ___@losawo.com with “Shine the Light” in the subject line.  The request must include your current name, street address, city, state, and zip code and attest to the fact that you are a California resident. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
